Vermillion: Daughter stands by statements, regrets video deposition

Kathleen Vermillion said Wednesday afternoon that her teenage daughter stands by her assertion that County Commissioner Steve Sisolak behaved inappropriately. But the former Henderson city councilwoman also said she regrets having her daughter give a videotaped deposition in the battle with her ex-boyfriend.

Here’s the content of two Wednesday interviews with Vermillion after I reached her by cell: "My daughter is at a soccer game right now, and I have not had the opportunity to speak to her," Vermillion said. When told of the existence of the Boutin affidavit she said, "I feel like this is a lynching. ... I can’t do this anymore."

She then launched into an accusation-filled statement about her ex-husband, accusing him of having a "criminal background" and of failing to make his "mandated child support payments."

"This is not a man of upstanding moral character," Vermillion said, noting that she has primary custody of her daughter.

After being read the essential elements of Boutin’s statement, Vermillion admitted, "I’m not saying there’s no truth to it. In hindsight, after having my daughter hurt to the degree that she was, I never should have allowed a video deposition."

After speaking to her daughter, Vermillion said the teen states that nothing she "said during the interview was untruthful. She does say she felt pressured by me to conduct the video deposition, but she stands by the content of it."

Vermillion added, "And in retrospect, having done a video deposition and having seen what’s occurred over the past week for both of us, we would have never agreed to a video deposition."

When reminded that she can be overheard on the unedited tape appearing to coach her daughter, Vermillion said, "I asked her questions that still are very concerning to me."

The mother then reiterated that her daughter’s "comments were absolutely accurate."

Typical politician's kid. Fifteen (15) years old, and already a flip-flopper. It sure will be interesting when the kid sits for a real videotaped deposition being adversarially questioned by some of Las Vegas' best litigators. My bet, by the end of the deposition, the kid will claim she only shops at Goodwill and Target.

Sisolak is doing exactly the right thing by going on the offensive immediately following a false accusation. In 1991, my female mayoral opponent also made a false and defamatory accusation against me. I foolishly waited until after I lost the election to take action against her. My lawsuit took 10 years to make it to the Nevada Supreme Court where a 19 page Decision was rendered stating she "acted with actual malice," and with "a reckless disregard for the truth." Though my name was cleared, it meant nothing because of the permanent damage from a decade earlier. Here is the Decision: http://stevemiller4lasvegas.com/supreme1.html .
My case set the legal precedent for any defamation action Sisolak may seek.

What Clark County Family Court Judge gave this woman custody of this poor child doing her mothers dirty work? I can only hope that the father of this child and the Judge involved do what needs to be done.This baloney is just an example of what many mothers do in the Family Court Arena on a daily basis. So Sad

Did the girl give a video-taped statement or a video-taped DEPOSITION? A deposition is an interrogation by the attorneys of the witness under oath. How can Vermillion have been coaching her daughter if it were a DEPOSITION?

My lawsuit took 10 years to make it to the Nevada Supreme Court where a ruling was issued stating: (1) she "acted with actual malice," and (2) she acted with "reckless disregard for the truth." These two requirements are the legal basis under Sullivan vs. New York Times for a public official to sue someone for libel or defamation. It's the case law precedent for a defamation action I recommend Sisolak file against the woman.

I am used to the paper telling only half the story but this is pretty bad. He bought the girls swimming suits and had them model for him, he is disgusting and should be treated as such. Just because he hates unions he is a good guy? He is a predator who dated a whacko, but it does not make him less of a predator. If I tried to list all the Nevada and Las Vegas pols that have documented their character while carrying out their personal vendettas in the press these last 10 years I'd need a couple of legal notepads. This place brings crazy to the front of the line, dresses it up and calls it sir. Unreal.
