Blame the employers, not the guy who snuck across the border

There seem to be a substantial minority of Americans who believe that since granting amnesty to 4 million illegal aliens 24 years ago had the effect of bringing us the 12 million illegal aliens who are here loudly demanding amnesty today, therefore giving amnesty to the 12 million illegal aliens currently in the country — without bothering to mine or otherwise make the southern border at least as secure as the fence around a typical military base or nuclear power plant — will result in "a comprehensive solution to the illegal immigration problem."

Sure, if by "comprehensive solution" you mean that 24 years from now we'll have 36 million new illegal aliens in the country, flooding our jails, evading responsibility for the traffic accidents they cause, sending their earnings "home" to another country rather than investing them in America, embracing none of our traditions of limited, constitutional government, demanding free education through college and free medical care for themselves and their extended families, and that all our signs be printed in two languages.

While well-educated, English-speaking would-be immigrants of every color with needed skills who are willing to obey our laws and embrace the principles of our constitutional republic languish overseas, simply because they lack a handy land border.

Furthermore, like kicking when the doc taps the knee with that little rubber hammer, this gang seems to believe they've come up with a really clever sound bite: They blame the presence of these illegal aliens on their favorite villain, "greedy corporate CEOs" who offer said illegals gainful employment.

One letter-writer to the Review-Journal today, for instance, asks: "Does anyone seriously believe that the illegal immigrant 'problem' would not be greatly reduced, if not almost eliminated, in a very short time, if the CEO's of corporations and owners of businesses that hire them were to serve, say, a minimum two-year jail term for first offense and even more years for subsequent offenses with a hefty fine? The problem would go away almost overnight. ..."

CATCH-22

I've spoken to some actual business owners — I don't hobnob with that many big-time "corporate CEOs," but I suspect a lot more of these illegals end up working for landscaping outfits and restaurant kitchens than for Goldman Sachs, anyway. They explain an interesting "Catch-22." Under current law, if someone applying for work who speaks with a thick Spanish accent (or even needs a translator) presents a set of documents which we know can be purchased as a package from any number of illegal sources at a current going rate of $125 — driver's license, "green card," Social Security card, etc. — the employer who has been advertising for help is legally required to accept these documents at face value, in many cases he or she IS NOT ALLOWED to carry his or her diligence or skepticism any further, lest he or she face quite harsh negative repercussions from a federal outfit called the "Equal Employment Opportunity Commission."

For instance, imagine how long a would-be employer would be allowed to run advertisements stating: "Thanks to the plethora of illegal immigrants from south of the border presenting what appear to be valid work and residency documents, we are going to follow the suggestion of those who blame 'corporate CEOs'  for the current illegal immigration problem: In order to do our part, no one who speaks with an accent that might lead us to believe they're from a foreign country need apply for this job. Skin color is no problem, but we're not going to hire anyone who sounds like they didn't grow up here, period."

Will those who propose "a minimum two-year jail term for first offense and even more years for subsequent offenses" for anyone who hires an illegal alien who has presented false documents, agree to allow such advertising? Will they agree to de-fund and disband the EEOC, or at least support legislation specifically instructing the EEOC to no longer go after employers who take such a step to avoid hiring any illegals?

Why not? No one is talking about refusing to hire based on skin color or religion or femaleness — just foreign accents or the inability to speak English like a native. Not only should this fall under the constitutional right of free association, but how can you propose jailing someone for an "offense," and then disallow them the most effective method by which they can make (fairly) sure they're not lured into committing the offense by a criminal cheat?

Unless, of course, those who stake out this position don't really want to find a way to force the illegals to go home, at all — unless this proposal is merely a scam, designed to silence the opposition, frighten capitalists out of creating new jobs, and distract attention from the fact they don't want any "solution" but another amnesty?

IS THIS A MONTY PYTHON SKETCH?

A guy on the radio Saturday asked, "If you could better your family's lifestyle by taking a few days' risk, wouldn't you sneak across the border?"

The problem is that this same question could be used to justify sticking up a bank.

Why don't they propose two years growing crops on the prison farm for the illegals who PRESENTED the false documents, for example? Or for anyone caught making up and selling such documents — a set of criminals who could be apprehended by a series of undercover stings so straightforward they could easily be carried out by Nancy Drew and the Hardy Boys?

This is like something out of "The Emperor's New Clothes." We're being asked to accept utter absurdities as established fact. "No way to round up 12 million illegals"? There's no way to round up all the nation's pot dealers, but I don't notice Congress making a lot of headway on a drug amnesty. Instead, we continue to happily fill our prisons with people who sell plant extracts less harmful than alcohol to willing adult customers.

In fact, assign a few immigration officers to question non-English speaking adults who try to register their kids for free tax-funded schooling, or as they exit hospital emergency rooms where they've sought free treatment, and you could fill up some buses in a hurry. Bus them to Galveston, place them on ships, dump them on the shores of the Yucatan. That's what Eisenhower did, quite effectively, with his "Operation Wetback." Start questioning anyone who visits a post office or a private competitor to wire money south of the border. (ICE officers ARE allowed in post offices, aren't they? How come we don't see them there?) Round up and question all the guys seeking day labor on street corners or outside local nurseries. Give them a fair chance to prove legal residency — but not "Oh, that Social Slave number isn't valid, or it belongs to some old lady in Duluth? Just gimme a few hours; I'll go buy you another one."

Round up and deport the first half million. Make it reasonably unpleasant, and the rest will start to get the message.

Until you create some harsh and reasonably likely negative repercussions for violating our immigration laws, we essentially have none. And a nation that can't control its borders — can't demand following the law and demonstrable allegiance to our heritage of limited government as conditions of citizenship — won't be a sovereign nation for long.

Vin:

Arguing now for MORE government?

Posting government officials in post offices? How 'bout 7-11? You know lots of Spanish speakers there too, maybe the local taco joint would be a good place for some ATF guys huh? While their there, in case any "executive types" well known to fail to pay their taxes might be questioned as well; then we could kill two birds with one "stone" eh?

Dang man, try and keep SOME integrity at least that would distinguish you from the rest of the staff of this "newspaper".

When I first heard about libertarians and the "less government" philosophy I remember someone asking, "since you don't want government to do THIS and you don't want government to do THAT, what exactly DO you see as a role for government?" The answer was, "guard the borders and enforce the contracts."

I strongly suspect that if these two roles had been adhered to these past 100 years the rest of you wouldn't whine about how unfair it is to keep illegals out or even how horrible it is to call them what they are. Illegals. Invaders.

Calling on government to carry out it's limited constitutional functions cannot be construed as calling for more government and it is certainly not inconsistent.

The fact that Arizona has now stepped up to the plate in place of a fedgov with a far different agenda is, I think, encouraging. Their logical next step is to secede and end the charade completely.

"Put up a bigger fence," is as much a joke as your, "It's not the employer's fault." The most famous of the corporations, (you 'don't hobnob' with), are the food manufactures and big box like Wal*Mart ("Always low wages").

They don’t worry about skin color; a Mexican accent or fake Green Card. The corporations reports to; and send money to; the Social Security (SS) Administration under the new employee's SS number. Invariably the SS Administration reports back to the employer that the new employee's SS number is invalid; or a duplicate (some used as often as 50 times at one corporation), and 'would they please look into this?'

Now this is where your corporate sponsored Republican politicians come in: The law does not require the corporation to follow up on this. They do not have to call the Border Patrol, or ICE or INS. Nobody has to make the employee verify their SS number, place of birth, citizenship, et cetera.

The employer is happy, because he has a new employee he can underpay and mistreat (because the employee doesn't want to make any waves or fight for a union). Our government is happy because the Social Security Administration still has money coming in from the employee and employer for those SS deductions. Nobody cares what happens down the road when 50 people try collecting from one SS account.

I was a cop in California in the 70s. Rounding up illegal's was a joke. INS bussed them to the border and within a week they were filtering back into town. We knew some of them on a first name basis.

Require employers that get the letter from SS to call the border patrol.

(Good luck getting that bill through congress…)

Let's all point fingers at each other, and never actually implement a solution. Only Republicans hire illegals! Only Democrats weaken border security!

The fascist/globalists want illegals in our country, otherwise Reagan would not have given them amnesty in the 1980's, and our borders would be secure today.

What fun it is pretending that the feds actually want the problem solved. Bush was soooo afraid of terrorism, yet left the borders wide open.

Yeah, I believe politicians want what's best for America...owa tafu liam...

I agree with Neal Boortz, this protest against Arizona's new law, is all about giving illegal aliens amnesty.

Let's put it on the ballot and see how many voting Americans think this is a good idea.

Or better yet, have each candidate specify what they want to do. Then we vote. Then we act.

As far as "what a fool am I"; ICE can't even pick up 80 illegals receiving free dialysis at UMC, 3 times a week.

How pitiful is that?

In response to Mr. Boorz, I say that the U.S. Constitution is not currently up for a vote.

Tom J, I hate to disagree with you, but our Constitution is not only up for a vote, but is in the fight of it's life.

Let's start electing people that believe in the original intent. Got any friends available Thomas Jefferson?

Can we agree on these things?:

1) If you want less of something, tax it.

2) Creating jobs is critical to our economic recovery and the well-being of many individuals.

3)Every regulation regarding employment is a form of tax.

Ergo, every new rule or regulation on employers means less employment.

Bad laws are meant to be broken. Or if this is not the case, I guess all those germans turning in thier jewish neighbors years ago were doing the right thing.

How can a person be "illegal" anyways? That is just silly.

Question to Vin. If I decided to hire an immigrant that did not jump through all the government hoops to clean my house every Sunday what should happen to me? Should the police be sent to violate my private property and my freedom of association? Should I be punished for not following THE LAW? A law I never contracted to follow?

Vin's libertarian street cred is seriously in question with his stance on immigration.

Blame the employers who hire illegal aliens? Sure ... but there is PLENTY of blame AND responsibility to be spread around. As for blaming employers, if this nation could (and would) be competent in providing employers a fail-safe method of investigating the "legal" status of a prospective employee, such as E-verify, I guess the problem of this invasion would not be such a crisis, huh? There are many foreigners who come to this country on school, work, or other visas, and when those visas expire, they just remain in this country like they belong here. Who is monitoring them? NO ONE..!!! Why bother requiring visas if we are not going to ensure that, when those visas expire, the foreigners will be deported? What a joke!

There is absolutely NO excuse for the millions of illegal aliens in this country. There is, however, a very good reason why they are here and have been here for years without being ousted back to their countries of origin. Those reasons are government incompetence, laziness, greed, ignorance, etc.

I am thrilled that the issue of illegal immigration has become a prominent one. It's about time! Americans are FED UP with the impotent excuses and reasons why our government has allowed this horrible and expensive invasion. We are also FED UP with the "sense of entitlement" which illegals arrogantly display.

I am ready to vote, and I will vote for those who NOW see the light and are hearing the voices of the people. We are NOT kidding! We are VERY serious, and we want the illegals out now!

This post is in response to

"Written by: David on Wednesday, May 12, 2010 at 3:32 PM."

Are you for real? YOU are part of the problem, not the solution we drastically need. Why would you hire illegals to clean your house? Do you not realize that YOU (or rather the pitiful salary you pay them) are the magnet which sustains them? Are you too cheap to pay a legal citizen to clean your house if you are that lazy that you cannot do it yourself? By the way, do you also hire illegals to do your gardening and landscaping and possibly clean your pool, too? Yes, probably!

Again, YOU are the problem. Take a good look in the mirror.

Another response to:

Written by: David on Wednesday, May. 12, 2010 at 3:32 PM?

I apologize, but your post is a bull's eye target for comment.

You stated, "Should I be punished for not following THE LAW? A law I never contracted to follow?"

Huh? On what planet to you reside? Since when do legal citizens have to contract to obey the laws? You SHOULD know what the laws are, right? Does someone have to remind you NOT to speed while driving, NOT to rob a bank, NOT to shoot someone, NOT to forget to file or pay your taxes?

How utterly moronic can you be?

Again, I apologize, but I just could not resist questioning your mentality.

Both the illegal alien and the employer are committing crimes. Punish them both.

BTW: Insisting the government perform its constitutionally mandated functions is not arguing for big government.

This is written in response to response to the "Written by: David on Wednesday, May 12, 2010 at 3:32 PM."

Yes, I do hire illegal when ever I get the chance. Why would I ever pay some one possibly twice as much for the same work? That would be rather stupid would it not? You see unlike you and Vin, I believe in freedom. That includes the freedom to contract out work to whom ever I please. But I guess you would use the guns of government to force me to use the people you deem okay. If you do not want to get the cheapest price that is okay by me. Have at it. See where I am willing to let you enjoy your freedom and you are unwilling to let me do the same? Shame on you. Also, please don't call me names (re: citizen). I am an American but have no allegiance to anyone but whom I have contracted with. Why would anyone feel allegiance to this federal government is beyond me but whatever, do as you like. See, there is me having no problem with people living their lives anyway they see fit. Yeah, an actual freedom lover is the problem.

If you don’t like immigrants don’t do business or associate with them. You have no right to force me to do the same. If you believe you do that is very sad and really shows you have no clue of the concepts freedom and liberty.

Jerry, you say the employer should notify ICE when they get the Social Security mismatch letter. Wouldn't it be easier (and cut out the middleman) for the Social Security Administration to just send the mismatch letter to ICE directly?

I want the borders enforced. I want criminal aliens detained and deported ASAP. But I don't want "employers" to be forced to be the immigration police, no more than I want landlords, grocery stores, doctor's offices, or gas stations to demand proof of lawful presence before they can engage in a simple financial transaction with a person.

In response to: "You SHOULD know what the laws are, right?
Does someone have to remind you NOT to speed while driving,
NOT to rob a bank,
NOT to shoot someone,
NOT to forget to file or pay your taxes?"

1. No. No one could possibly know all the laws. They are far too numerous. It is an impossibility.

2. No. I do not need an arbitrary number posted on the side of the road for me to determine a safe speed. I go by experience, traffic congestion and road conditions.

3. Common sense and common law let me know robbing banks is a bad idea. Again no other law is needed. But I do also follow NAP (Non Aggression Principal).

4. Again, common sense, common law and NAP. Nothing else is needed.

5. I try never to pay taxes. Notice I did not write "my taxes", as you did, as they are not mine. The IRS might claim they are mine but I have never contracted with that org. As a side note, how does it feel to be on the same side as the IRS? Eewww.

Simple fact is you and Vin wish to trample on my rights, rights I was born with, in your collectivist quest against immigration. Not very American of you. Come to think of it, lets see some ID.

Who was responsible when the British took opium from India and sold it to the Chinese?

The British?
The Chinese addicts?
The Indian poppy farmers?

So the illegals?
the Mexican Government?
American Employers?
American consumers?

So the bank has more power and wealth (at least some of them) and the bank robber is poor, so the robber is in the right?

The employer has the power and the illegal is weak and powerless?

You all have no right to tell me what I can and can not do on MY PROPERTY. You don't like it move to a country that doesn't have strong property rights. And, yes, I have the weaponary to defend my property from those that seek to infringe upon it. Keep that in mind all you bigots.
