Supreme Court rules in foul ball case

The Nevada Supreme Court said today that stadium operators have a limited duty to protect spectators against injuries caused by foul balls that are errantly projected into the stands.

But the court said the operator in the case at hand, Mandalay Sports Entertainment, doing business as the Las Vegas 51s, “satisfied its duty as a matter of law under the facts presented in this case.”

The divided opinion arose from a case involving Las Vegas 51s fan Kathleen Turner, who was eating a sandwich in the Beer Garden at Cashman Field in 2002 when a foul ball struck her between the eyes, breaking her nose and cutting her face.

    douglas wrote on April 17, 2008 06:53 PM: then it would follow that those spectators who were killed/injured at that drag strip "incident" a couple months' back, have no claim. they were in back of the "barrier" while seated in the bleachers and should have been aware that those cars were traveling at high speeds.

    drag strip operator, 1; the dozen injured/killed paid spectators, zero.
