Harrah's named in contractors board complaints

Builder also cited in county investigation




Clark County names Harrah's Entertainment as the contractor in three of its complaints recently filed with the Nevada State Contractors Board for failing to follow state law. Ford Contracting, a local company, is named in the county's fourth complaint.

That complaint ascribes to Ford a role in remodeling guest rooms at one hotel, Harrah's Las Vegas.

  • "The complaints name Harrah's Entertainment as the contractor that allegedly performed construction work without permits, as required by state law, at the Rio Hotel, Harrah's Las Vegas Hotel, and a warehouse building owned by Harrah's, located at 3665 W. Twain Ave.," according to a statement issued Wednesday for Clark County by Erik Pappa, the county's director of public communications. Those three sites account for three of the complaints filed.

    Harrah's Entertainment declined to comment on the complaints until management has had time to review them. 'We just received them," said spokeswoman Marybel Batjer on Wednesday afternoon. She is vice president of public policy and communications for the company, which is the largest gaming enterprise in the world.

    The complaint copies sent by the county to the Review-Journal are dated Oct. 11. The contractors board itself is not permitted by state law to confirm that the complaints exist.

    "I've looked at the complaint," said lawyer John Moran Jr., who represents Tom Ford of Ford Contracting.

    "And the county does not have standing, OK, under the law of the state of Nevada to file a complaint like that."

    Property owners ordinarily file complaints with the board, while the county does not own any of the locations involved in the complaints.

    "Development Services (a county department that houses the building division) filed the complaints with the Nevada State Contractors Board because the board has jurisdiction over contractors, and is the appropriate agency to investigate whether contractors should be subject to disciplinary action," the county statement reads.

    Moran declined to make his client available to the newspaper. "There's not any interview going to happen," he said by telephone Wednesday.

    According to the Nevada Secretary of State Web site, Ford Contracting was formed in 1977, and Tommy A. Ford is its president. It has held a county contractor's license since 1977, according to the county's Web site.

    Batjer has verified that Ford Contracting has done work for Harrah's over the years, but said her company cannot yet pinpoint any role by Ford in controversial remodel projects that took place at Harrah's Las Vegas on the Strip, or the Rio Hotel on Flamingo Road. Both hotels belong to Harrah's Entertainment.

    "We have people going through the files. They're looking at all contracts. It's a rather laborious effort to make sure when a contract was let, for what work, for what period of time, by whom," she noted. "We're trying to arrive at a thorough answer for you."

    The specific dates that remodeling work was done at the two hotels have not yet been officially established, but six workers told the newspaper they helped carry out the work at the Rio from late 2004 through early 2006, and at Harrah's, in 2006.

    Both hotels have numerous guest rooms currently closed, as four investigation teams -- from the county building division, county fire department, Harrah's and an independent law firm hired by Harrah's -- comb through the properties to detect work that either is below standards set by various safety codes, or is undocumented because it was carried out without building permits or safety inspections. Harrah's has repeatedly stated its eagerness to cooperate with authorities.

    The Twain address cited in one of the county's complaints to the contractors board refers to a building occupied by Roman Empire Development, a Las Vegas-based subsidiary of Harrah's that was formed in December 2006. Some people who were formerly employed directly by Harrah's properties, to supervise or carry out construction projects, now work for Roman Empire, according to remodel workers interviewed.

We paid for Berber carpeting &nd an inferior carpeting was installed in its place. Whoever inspected our home for all our upgrades evidently "signed off" as "ordered by the homeowner" and we paid for Berber and this carpeting was never installed. Del Webb refuses to compensate me for the difference, even though they are aware of it, of Berber carpeting and substituting a lesser quality carpeting.

I did not have direct contact with Mike Nasby, but seeing that Mr. Nasby was Mr. Adams boss and having seen Mr. Nasby at the Rio from time to time it is safe to add Mr. Nasby to this list. Marilyn Winn was aware of the work being done at her hotel, aware enough to give us a little party to thank us for the great work that we did on the Rio Remodel Project...in Marilyn Winn's defense I don't think that she was aware of the fact that the work was being done illegally. Let me not forget Ron Cozart, Business Representative for the Operating Engineers Local 501, who provided the personnel for the remodel projects.

    Harrah's provided the Engineers to do the electrical & plumbing at the Rio. Ford Contracting did the framing, drywall, wallpaper & painting. Statewide Fire Protection Company did the Sprinkler Heads in Tower 1. T-Nick Tile did the tile work. Ford & Statewide are licensed contractors.

    The county fears casinos and I just don't understand why?!

    Harrah's management personnel that were directly responsible for all of this illegal remodel work would have been successful in covering this all up if Joan Whitely from the Review Journal had not gotten involved! Harrah's consistently across the board answered my complaints with the following: "the scope of the work did not require permits or inspections as it was just cosmetic in nature." What you are not hearing about are the other remodels that were done without permits as well such as: the honeymoon suites at the Rio; the new payroll offices at Harrah's; the old payroll office at Harrah's; the remodel last year that they started in the South Mardi Gras Tower at Harrah's, which they began without permits that is until I turned them in to both the County & OSHA - they started this at the beginning of June 06 and the permit was issued at the end of July (did the County Inspector stop work when he caught them red handed?...no he allowed them to continue to work - don't try this at home folks); then there was the little concession stand just to the left of the Carnival Court Bar's main entrance which they tried to build without permits (when the inspector showed up and the Harrah's Chief Engineer came to meet him - they found out that they knew each other, and in front of witnesses the inspector was overheard saying "that if it were up to me I would let you get away without pulling permits", fortunately for him he called his boss and Harrah's was forced to pull the necessary permits). Don't even start me on the asbestos issues at both Harrah's & the Flamingo hotels, which is another whole issue by itself.

The County manager should have taken action when she was informed but no she did nothing hoping it would go away (Fred) Mr. Moran is correct the County has no standing to file a complaint again the hotel etc, this is the County’s way to pass on the problem and errors they made to someone else. The County is at Fault along with the casino company, who was hired as the contractor??? The contractor should have pulled the permits, and when the county found out there were no permits at that time, the job should have been shut down until permits were pulled and inspections done.
    Don't expect any heads to roll, the county commissioners are good at cover-ups, the county manager is good at lies and cover-ups, the hotel has a great deal at stake their gaming license I would hope they would not participate in a cover-up- they have too much to loose. The county has nothing to loose, only the press attention. Rodman your right it is another shinning moment in bureaucracy and stupidity. We should just expect it for substandard government management and political leaders who only care about getting elected. These people will do whatever it takes to cover-up so it will not hurt their elections. So accept it because you cannot change it. The county manager only cares about keeping her high paying job where she has the opportunity to do any and everything she wants without any oversight and management control.

It would be great to start with the County Commission but the only way to do that is through elections so go to the next in line, the county manager, department heads who handle this type of construction/permits etc., county inspectors, right on down the line to and through the Harrahs employees. It makes you wonder how long and how many times these type of shoddy business affarirs go on and how many and who all is on the take. Once again your county government comes through with another "shinning moment" in bureaucracy and stupidity.

Ford Construction was involved in the remodel of all three of the Ipanema's towers at the Rio. They were responsible for all of the framing, sheetrock installation, wallpaper & painting done on the illegal Rio Hotel Remodel Project. I guess your esteemed Harrah's management team of: Mike Nasby, Tom Adams, Mike Whitehead, Leon Vermillion & George Kirkwood have all suffered amnesia at the same time forgetting that Ford Contracting was an integral part of the project. What happened to Harrah's code of ethics: the one that says that you are supposed to be truthful - I guess that the managers at Harrah's are exempt from this...what a surprise!

    Maybe Tommy Ford should talk to Sam Barto, as Sam brought out the checks to his workers at the Rio every Friday. Could it be that Tom Adams & Tommy Ford are such good friends that they will protect each other to the bitter end? There are plenty of witnesses that can & will not only place Ford Construction at the Rio Hotel, but will testify that Ford Contracting participated in the illegal remodel project hand in hand with Harrah's. First hand, I have seen Ford Contracting participate in numerous illegal remodel projects for Harrah's. Ford Construction as a licensed contractor knows when they need to pull permits...they are just as guilty as Harrah's in all of this.

    John Moran, Jr., either your client did the work or they did not...which is it? If they didn't do anything wrong then telling the truth shouldn't be a problem. If they did, they should be held responsible, and they will be in need of your services when this goes to court.
