REMODELING PERMITS: County OKs response audit

Company to check handling of whistle-blower's alert

An international company with expertise in the construction industry was hired Tuesday to investigate the handling of a complaint about remodeling completed at two hotel-casinos without permits or inspections.

Although one Clark County commissioner cast doubt on the need for an audit, the board voted unanimously to hire Kessler International.

The company will determine whether the county responded properly to whistle-blower Fred Frazzetta's concerns about possible safety hazards from construction work at the Rio and Harrah's Las Vegas.

The company will assess the efficiency of the investigatory procedures used by the building division, which is responsible for issuing permits and inspecting remodeling and new construction.

  • Commissioner Tom Collins voted for the $50,000 audit and said he thinks it will clear the county of any wrongdoing. "I'll support this because I know we've been doing our job and doing it well," Collins said. "I don't want to have a study, but if it makes people feel good, then go ahead and do it."

    Frazzetta, who worked on the remodeling projects, filed a complaint with the county in August 2006. Six months later, an inspector visited the properties and closed the case the same day.

    It was not until the Review-Journal began asking questions that the county formally reopened the investigation in September.

    Because of the re-inspection, Harrah's Entertainment closed 140 rooms at the Rio and more than 500 at Harrah's.

    Collins dismissed the newspaper's role in prompting a more thorough inspection of the remodeling work and said County Manager Virginia Valentine already had started the process.

    "I think our county folks did a good job, the staff did a good job and the inspectors did a good job," Collins said. "It was (Development Services Director) Ron Lynn who got us in there, not the R-J stories."

    Collins said he expects no disciplinary action to be taken against county employees. They had no idea Harrah's was remodeling its properties because no permits were issued.

    "If someone is going to get fired, it should be someone at Harrah's," Collins said. "We're not supposed to go into your bedrooms and kitchens and just start tearing apart walls."

    Commissioner Chris Giunchigliani directed Kessler International to recommend a timeframe in which the county should investigate a complaint once one has been filed.

    The company will recommend new procedures to ensure property owners obtain the necessary permits and inspections when they embark on remodeling projects.

    Most commissioners and county administrators have declined to say whether the county could have responded more efficiently to the safety concerns, reserving their comments until after the audit is completed. Kessler is expected to have a report to the county by the end of the year.

    County Auditor Jerry Carroll, who recommended Kessler because it has no ties to the gaming industry in Las Vegas, said the company will interview deputy district attorneys who offered advice to the building department, Lynn, Frazzetta and the inspector who initially visited the properties after the complaint was filed.

    Frazzetta attended Tuesday's meeting and offered his support for the audit. He said he has additional information about the remodeling work that he plans to provide to the auditors.

    "I strongly suggest you give approval to look at what took place here," Frazzetta said.

Maybe you would like to explain to the public as to why no charges have been filed against Harrah's or any of the other licensed contractors that participated in the illegal remodel projects at Harrah's Casinos, which is a confirmed fact at this time. I guess it is okay in your book that Harrah's not only did this illegal work, but they also left behind multiple public fire safety hazards in the wake of these remodels, which is also documented at this time. If there had been a fire Commissioner Collins lives would have been lost just like what happened in the MGM Grand Fire of 1980. Harrah's knew what they were doing, and they were willing to risk the public's safety - which they are obligated to protect. What are the laws for Mr. Collins? Harrah's has already broken the Public's trust in a big way, and you are doing the same by not standing up and making Harrah's & the other companies responsible for this fiasco accountable for their actions! Do your job, get off your butt, stop running your mouth and take action - call for a criminal investigation into these illegal acts...protect the public as you are entrusted to do! You are making a mockery out of the office that you hold, and in so doing you are breaking the law yourself...making you no better than the people that were responsible for this in the first place. Harrah's is a multi-billion dollar company - they have no excuse for having done what they did...none. You, the other County Commissioners, the Clark County Building Department, the Fire Department, the DA's office, the AG's Office, and maybe the FBI need to restore the public's trust.

    Your comments are ludicrous given the facts of this case: 1. It took almost six months for your stellar inspector to make it out to the Rio. 2. He can't remember who he met with...I guess he has his own personal key to get into the rooms. 3. He didn't notate what rooms that he entered for his inspection. 4. Whatever plans he went off of to make his determinations are not plans on record at the Clark County Building Department. 5. He didn't even get it right on the number of Phases it took to complete the Cabana Towers, which was four not three. 6. Mr. Maddox conveniently claimed that the 19th floor was originally super suites in all three towers, which was an out an out lie. 8. He closed the case the same day as his inspection and even though it clearly stated on the original complaint that I was to be notified of his determination - it took almost another 3 months for me to get a copy of his "fantasy" report. I will give Mr. Maddox credit for getting the Rio's address right on his report, and from Mr. Collins statements I am sure that Mr. Maddox will get a well deserved raise after all of this.

    Commissioner Collins, if it had not been for the efforts of Joan Whitely at the Review Journal this never would have seen the light of day...you know it, I know it, and now the public

If you are interested in helping contact Joan Whitely and give her your email & phone number so that I can reach you, and I will. We need to show all involved that we no longer will tolerate elected officials and public officials who are responsible for the publics safety and health protecting the big corporations as they have in this town for many years. We can send them the message that business as usual is no longer acceptable and will no longer be tolerated in Las Vegas! I know that there are more people out there with information such as the information that I came forward with that can make a difference. Now is the time to speak out - know that you are not alone. The public has shown acceptance of this irresponsible, unethical, and illegal behavior by not standing up and saying NO. If we want to clean - truly clean this up and make a difference...we need to do it together as one unified voice. For change to take place we must take action - words will not get the job done...we must become involved, and more importantly we must believe again the simple fact that we can make a difference TOGETHER.

    The blatant truth in all of this is the fact that the people that we have entrusted to protect us & our families have sold us out...some for their own personal gain and others because they are afraid for their jobs so they continue to do what they are told.

Thank god there hasn't been a tragic fire at the Rio to bring this faulty process to light. Collins should be thanking Frazetta and the RJ and stop self congratuling himself. Collins just sounds like a knucklehead.

They are only interested in bailing out big business. They would hang a little guy out to dry.

There needs to be another Federal Investigation level or the truth will never come out. Too much graft and corruption at city/county or state level agencies and politicos to move this ball forward. At the very least Harrah's total disregarding the building code laws with impunity is because of their entitlement mentality or continued local corruption with payolla being slipped to the building inspector agency boys to look the other way!

    This "investigation" is a joke. Commissioner Tom Collins has already pre-determined its outcome with his idiotic rants. I'm sickened by how the casinos run this town... and continue to run it into the ground. The politicians we elect continue to take bribes, kickbacks, and money under the table to stay quiet like the good little doggies they are.
