CORRECTION -- 12/15/07 -- A story in Thursday’s Review-Journal on Stefany Miley’s intention to run for District Court in Department 23 misstated how long she served as a Family Court judge. She has three years of experience.

Family Court judge seeks move up

Embattled District Court Judge Elizabeth Halverson has faced a temporary suspension, accusations that she fell asleep on the bench and created a hostile work environment and a flurry of negative press.

She's now facing an opponent in the 2008 election.

  • On Wednesday, Las Vegas Family Court Judge Stefany Miley formally announced she was running for the District Court Department 23 bench currently held by Halverson.

    "I think I can better represent the people in Clark County," 36-year-old Miley said.

    Miley didn't sling any mud at Halverson but called her opponent "controversial."

    Miley won her seat on the Family Court bench in 2004, replacing incumbent Robert Gaston. Her term doesn't expire until 2010. Miley is not required to resign from her current judicial office to run for another.

    Miley said she is the right person for the District Court seat because of her six years experience as a Family Court judge, nine years as a trial attorney and her knowledge of many areas of law.

    Miley said she wants to handle civil and criminal cases and sees the Department 23 position as a move up the judicial ladder.

    Miley said she hopes one day to be chief district judge, a position currently held by Judge Kathy Hardcastle.

    Miley said she has already been endorsed by the Las Vegas Police Protective Association.

    Miley received a bachelor's degree in journalism in 1993 from Texas A&M University and received her law degree from California Western School of Law.

    She moved to Nevada in 1995.

    Halverson is currently under suspension.

    On Nov. 1, the Supreme Court unanimously upheld a decision to suspend her because of allegations that she harassed employees, couldn't adequately conduct criminal trials, and communicated improperly with jurors, among other accusations.

    The court ruled that Halverson's conduct "posed a substantial threat of serious harm to the public and to the administration of justice."

    Halverson was elected to a two-year term in 2006, defeating Family Court lawyer Bill Henderson.

    Halverson couldn't be reached for comment.

    Bill Gamage, Halverson's attorney, said she plans to run for re-election.

    "Judge Halverson fully intends to defend her seat," he said. "She believes, in her role as a judge, that she could do a lot of good from the bench.

    "This is a job she wants for the rest of her life," he said.

    Miley doesn't see that men have rights too wrote on April 24, 2008 08:40 PM: ...she just sides with the cops and firefighters. They can be women too, you know! She is going to side with the very people that endorse her. Her campaign keeps stating that she keeps Las Vegas streets safe. In divorce court??? That is confusing! Miley keeps children away from their parents for 5 years or more. Parents that have other children at home that have never had a chance to meet their siblings, parents who are good, loving, caring people. She does not need to go to another court, Miley needs to get off the bench!

    I wonder why in Jane Anne Morrison's mind, this makes Saitta unqualified for Supreme Court, but it's not an issue when it comes to the other justices?



    Likewise, I searched reported cases in which the justice (as an attorney) argued on behalf of client in a case that was reported. Some of the justices have no cases, most have one or two. A couple had several.



    Morrison made the completely false accusation that Saitta had no reported cases prior to becoming a judge. It's apparently not relevant to Morrison that some of the justices have the same or fewer reported cases.



    It is generally not true that district court judicial opinions are published. A handful of states, New York, Iowa, and others, do publish district court judicial opinions. I am told that Nevada does not.



    There is an electronic database of "trial court orders" from district court judges in Nevada. The orders are considered "non-published." Nonetheless, Saitta has as many or more entries in the database than other justices/judges.



    The truth of course that "scholarly publications" are rarely published by sitting judges. And reported cases are not an accurate measuring stick of judicial competence.



    THE FAR MORE IMPORTANT ISSUE IS WHY MORRISON WANTS TO IMPEACH SAITTA FOR HAVING THE SAME QUALIFICATIONS AS THE MALE JUSTICES ON THE NEVADA SUPREME COURT.



    Morrison has done very serious damage to the reputation of a Nevada Supreme Court justice for no good reason whatsoever. It's really quite disgusting.

    Since it's appellate cases that are reported, and there's no intermediate court of appeals in Nevada, how would a case over which Saitta presided be reported unless it was appealed to the Supreme Court?

    If you're trying to argue that there aren't any Nevada Supreme Court cases reported that were appealed from her District Court, that's absurd.

    Earlier in the week the accusation was that there had never been a reported case at which she had argued on behalf of an appealing party. Can you explain?

    I'm sure Hillary would like that!!!

    If the general public sticks together with a common goal for a level playing field (bi partisan best qualified candidate gets and keeps the job) that serves the best interest of Nevada voters and citizens ...better schools, roads, no special interests (corruption).. we might even have a state to be proud of.

    Connect the dots, get rid of the bad guys, hold elected officials accountable, no mercy!!!

    No voter should trust anyone to take care of their due diligence for them.

    If Nevada wants change the voters need to get DEEPLY involved to understand who will be representing them based on their vote.

    Others can assist voters, educate the 'general public' and encourage them to do their own research on how to connect the dots and raise public awareness...but no one should rely an anyone else's opinion or spin for whats best for themselves, their family, and the future for nevada.

    We need to get the bad guys out but voters need to see for themselves what their elected officials do at the voters and tax payers expense and why this state is the way it is.

    Otherwise we all deserve what we have and continously allow.
