JOHN L. SMITH: Let's count reasons judge's boorish behavior should get him removed

If you're like me, you read recent articles about District Judge Nicholas Del Vecchio linking him to a litany of civil sexual abuse and sexual harassment allegations and found yourself asking a question:

What is this little black-robed weasel still doing on the bench?

  • Del Vecchio is named in a 38-count complaint filed by a special prosecutor for the Judicial Discipline Commission.

    The complaint runs 31 pages and outlines a pattern of behavior that shouts to have Del Vecchio yanked from the Family Court bench like an abscessed tooth.

    The complaint's lowlights include allegations Del Vecchio, before taking the bench in 2000 after seven unsuccessful tries, took nude photos and coerced the daughter of his ex-wife into performing oral sex on him. Although Del Vecchio denies the allegation, and the passage of time and lack of physical evidence would make the accusation difficult to prove, the complaint written by commission attorney Mary Boetsch lists a withering litany of other damning accusations that will certainly be much easier to illustrate.

    There's Count 11, in which former court clerk Patti Camarote swears that in 2003 she was told by Judge Del Vecchio to have sex with law clerk Michael Bognar to "make a man out of him."

    There's Count 13, in which former judicial executive assistant Wendy Cox says Del Vecchio told her to date "certain attorneys, to go out to lunch or dinner with them, because you could tell they were interested in her and she could thereby solicit and obtain campaign contributions for your campaign; that you stressed to her that she should dress nice which she understood to mean seductively," according to the complaint.

    There's Count 15, in which former bailiff Richard Tamez swears he heard Del Vecchio make "racially related remarks" in court. According to the complaint, the judge once asked, "Where's my lazy Mexican bailiff? He's probably asleep under his chair."

    There's Count 20, which finds Family Court employee Beata Funk accusing Del Vecchio of making numerous inappropriate sexual comments about her.

    There's Count 26, in which former court clerk Wilma Sawtelle overhears Del Vecchio make numerous "sexually suggestive" remarks about female litigants and attorneys.

    And I'm sure Family Court Judge Stefany Miley will be mortified to learn what her colleague is alleged to have said about her in Count 29.

    Like a smutty lounge comic who refuses to leave the stage, the judge's inappropriate comments just keep on coming.

    There are far more presumably easily verified accusations of misconduct and inappropriate behavior in the complaint's 38 charges.

    Unless you are an unabashed believer in complex conspiracy theories, the large number of people who say they experienced the judge's boorish behavior make any thought that Del Vecchio's courthouse enemies are out to get him seem more than far-fetched. If half the charges don't stand up, that only leaves him culpable in 19.

    Which brings me to today's question: Why hasn't the Judicial Discipline Commission swooped in to remove Del Vecchio from the bench? Why hasn't Chief Judge Kathy Hardcastle dropped the hammer and stripped Del Vecchio of his cases?

    The complaint is fine, but the commission saw fit to remove District Judge Elizabeth Halverson from the bench without an official complaint. Hardcastle moved like lightning to take away Halverson's caseload.

    There's little in the complaint against Halverson that even remotely compares to the depth of sleaze of which Del Vecchio stands accused. A rookie judge, Halverson is accused of falling asleep on the bench, botching some rulings, and verbally abusing the hired help.

    Del Vecchio has been drawing a salary from us taxpayer suckers since 2000 and is up for re-election this year. His unprofessional comportment, as outlined in the complaint, leaves the commission and Hardcastle with no reasonable choice but to act quickly.

    If Halverson really was such an imminent threat to the bench that she had to be escorted from the building before any ethics charges were filed against her, then what does that make Del Vecchio?

    Does anyone reasonably believe he can conduct his duties now that these blistering allegations against him have been made public?

    If Halverson needed to be removed before the filing of an official complaint against her, then Del Vecchio ought to be hanged from the courthouse flagpole.

    I'm guessing a few of the judge's former employees will gladly provide the rope.

My ex-husband and I have been in and out of court since Aug 2000 over my son, and EVERY SINGLE TIME, this judge has given leniency to the ex. My ex is a drug addict and abusive, yet for YEARS he gave custody to him and I had to pay child support and travel costs to be with my son. When my ex got his car repo'd, evicted, jobless, etc., THEN I was given custody, but guess what? the ex doesn't have to pay child support, only visitation, for 3 years, SO HE CAN GET ON HIS FEET. What kind of b.s. is that? We are struggling and suffering because of him. TAKE HIM OFF THE BENCH!

My ex-husband choked me until I passed out in front of my child, my ex-husband threated suicide while I was at work and he was my sons caregiver. I had to have the fire department & EMT's go to my home and they found him passed out in the tub with a bottle of rum and a razor. He was committed for 72 hours due to this and guess what Del Vecchio decided? That my ex-husband was fit enough to not only have joint physical but legal custody. My son has now ended up abused, gotten a truancy warning and every scar on his body has happened in dads care. Yet every time I go to court I loss more time with my son. I hope they hang this man out to dry. I have a copy of the 31 page complaint against him and have yet to finish reading it because it is hard for me to stomach some of the charges brought against him. ESPECIALLY the fact he is accused of having sexual relations with his 14 year old step-daughter. He sickens me.

    And who oversee's the Judicial Committee? Who is responsible to discipline any member of a committe tat partakes in unlawful acts, say for example conspiacy.

    Is there anyone listening? Is the RJ listening or doing the norm, Censorship.

    They are more than valid. I am sure you will not be the most popular guy at the Review Journal for doing so.

    Your buddy, Mary Jane Morrison is clearly connected to Hardcastle and the court. There is no question she has gone overboard (WAY overboard) trying to paint Halverson in a bad a light as possible.

    People have a right to hear both sides.
    People have a right to know the real truth.

    Ms. Tackett I am with you. I decided to do as you said. I went through the Supreme Court website and looked at the various documents.

    There is NO question you are right on the money.

    Why would the Commission be so quick to remove Judge Halverson who "alleged" complaints do not compare in any way to the magnitude of those against Judge Del Vecchio.

    Although this is not a case about one Judge vs. another. It does show EXTREME bias on the part of the Court and the Commssion.

    It makes no sense for the Commssion to spend it's time and resources on silly complaints regarding a 4 month Judge when they have 2 years worth of CRIMINAL complaints against another.

    There clearly is a strong force to remove Halverson from the bench and it is not from the public.

    While I did not vote for Halverson the first time around, I WILL vote for her now. Reason being, she has NOT been given the chance to do the job she was ELECTED BY THE PEOPLE to do.

    Kathy Hardcastle, Charles Short, The Las Vegas Reveiw Journal all made sure that Halverson would not get that chance due to their own vedentta's or prejudice.

    In AMERICA people's votes are supposed to count. The idea that a "Commission" that is clearly bought and sold has the authority to remove what the people have voted for is a total misuse of power.

    How many other judges have fallen asleep on the bench? How many other judges have made mistakes, even much bigger then what Halverson was suppose to have done? How many other judges have treated their staff badly? Trust me you what be amazed on all counts. If anyone would take the time to read the emails, and see what a conspiracy it was to get Halverson off the bench.
    People we are talking about a justice system, that is showing no justice. You elected her and you have allowed these people to crucify her. Why aren't you asking questions about really went on, why the Discipline Commission only wanted to hear one side.
    Do you really think that what they have known about Del Vecchio for two years and have done nothing compares, to a new judge that was targeted before she ever took the bench.
    It's time you all heard the other side. Demand it from the press and the news stations.
    Let's re-elect her and show them they can't take our decision away from us, with their dishonesty.

    She is incapable of running the 8th District Judiciary. Between her vendetta against Halverson and her bias friendship with Del Vecchio she is out of control.

    How could she remove Halverson from office yet allow a sex pervert and child molester to remain in office and keep it hush, hush for 18 months.

    Why did Kathy Hardcastle not push the "committee" as hard as she did to remove Halverson? Halverson did nothing wrong that any other judge has done. It is not illegal to fall asleep once on the bench for a few minutes due to a medical issue. It is not against the law to demand that your staff work their full hours and to occassionally put in some overtime. It is not illegal to be obese and disabled.

    It IS illegal to have sex with a minor. It is illegal to sexually harrass people working for you. Del Vecchio has done all this and continues to preside over cases.

    The threat to Justice to the public is having a Cheif Judge who is so hateful that she cannot manage the court fairly and properly. Her priorities are all out of control.

    Please vote against re-electing Kathy Hardcastle. She is a mess.

    Thank you for your article revealing how big of a pile of poop Del Vecchio is. I've waited since 2003 for the bomb to blow up in his face. I had Del Vecchio as my judge when my husband and I devorced. My husband is a very important man in Vegas he builds casinos and knew people high up. I was a stay home mom that had 5 kids from age 3 to 14 at the time very devoted to my family. Del Vecchio took my kids and my home away from me left me homeless. shortly after the evaluation of my husband and I. The counceler stated that the kids needed to stay with there mom and my husbanded needed to go though parenting class before he should see the kids again. Del Vecchio took that evaluation and put it in his personal files in his office. He ruled that I have to pay my ex- husband 300.00 a month and I only get to see my kids if my ex say's it's alright I've got to see my kids 2 times in five years once for a week and the other for 9 days. Del Vecchio caeled my case so no one could see that he was payed off by my ex- husbands friends. They couldn't get one thing on me except I was a stay home mom and did't have a job.I was told by my husband attorney and del vecchio that I was living off the man I bedded and that if they didn't take my kids away from me that they would be a looser that does work like me, the quote the apple doesn't fall far from the tree. My children and I cry every night for each other.Thank you, Jami
