Filing of new lawsuits brings total to 14

A new round of lawsuits was filed Wednesday in District Court against the Endoscopy Center of Southern Nevada.

Among the new cases was a medical negligence complaint by Craig English, who says he contracted hepatitis C at the Las Vegas clinic. He underwent colonoscopies at the clinic at 700 Shadow Lane on Aug. 9, 2007, and Sept. 13, 2007, the suit filed by lawyer Ed Bernstein says.

  • Health officials said last week that the clinic exposed patients to HIV, hepatitis strains B and C, and other blood-borne diseases when staff used contaminated vials of anaesthesia on patients. The Southern Nevada Health District sent letters to 40,000 patients who visited the clinic from March 2004 to Jan. 11 of this year urging them to get blood tests.

    Wednesday's new cases also included a class action civil conspiracy suit against the clinic's doctors and staff. Fourteen lawsuits have been filed against the clinic since Friday.

    Here's a little insight, the insurance companies never lowered the rates after the caps went into effect.

    The only people affected by the caps are the victims who get less money now when their doctor amputates the wrong leg...the doctors pay the same amount as they did before...the insurance folks are the ones laughing all the way to the bank...

So why is it that the Doctors' who caused this outbreak of Hepatitis C and other health scares are not being asked to submit their licenses. The nurses have already done so, and even though they gave up their license they should still be held accountable to anyone they injected through criminal charges. Where's the doctors?

    Are you insane? wrote on March 06, 2008 12:32 PM: Attorneys did not increase insurance rates, insurance companies increased insurance rates. You want proof? When the caps went in place, and the people of Las Vegas (and their lawyers)were limited in what could be recovered, did the "fair minded" insurance companies lower their rates? ABSOLUTELY NOT!! Ask your doctor if his insurance rates went down. So people cannot recover, because caps are in place, and insurance companies do not have to pay out, but doctors are still paying in as much as ever, and even more! If lawyers were the problem then the caps would have been the solution, but they were not. The problem is the insurance industry will charge charge charge as long as Las Vegans will let them. In the mean time people cannot make the recoveries they should make because of the caps, and doctors are told they have immunity beyond the caps. So we get exactly what happened with the Endoscopy Center. Imagine telling truck drivers, "you really should not speed, but there is no significant penalty if you do, so please don't speed and um, we will just trust you not to speed." That would be crazy, but it is exactly what we have done with our doctors. Do not be suprised when more ridiculous behavior from medical centers all over town keeps coming to light in the coming weeks and months. Heaven help us all if people keep looking to the attorneys as the scape goats.

    drooling attorneys wrote on March 06, 2008 10:23 AM: Most of us heard the news and were shocked and saddened for everyone at risk. Lawyers heard the news and had visions of dollar signs. They will be the only winners in this whole sad mess.

    What a shame,the people who will need the money the most -- those who get the bad news of a chronic and possibly terminal disease will be the losers left with little money for treatment.

    The lawyers also see an opportunity to change the law voted in which put a limit on payout. Of course in all their ravings they won't mention that it was brought about because of their greed. Not every lawsuit has merit and not everyone deserves money. But you will never convince an ambulance chaser of that.

    It was rather disgusting to see people on the news with their lawyer before they even had a blood test. Somehow, calling an attorney wouldn't be my first thought when told of a health risk.

Never mind, I forget he the others are hoping for a big cash payout because of the huge legal fees that will be facing the oppisition. That's the only way these guys make money. Once these suits go into real litigation they become to costly for the Bernsteins, Lerners, Golightly and Kutners to pursue. They will usually opt for what ever they can get and tell their clients it was for the best.
