City issues complaint against clinic

Las Vegas set the wheels in motion Wednesday to revoke the business license of a medical clinic at the center of a health alert involving tainted syringes and vials of medicine.

The City Council issued a complaint alleging that the Endoscopy Center of Southern Nevada at 700 Shadow Lane is a "public nuisance" that conducted business in "an unlawful, illegal and impermissible manner."

Mayor Oscar Goodman made it clear he wanted the matter dealt with quickly.

Jay Brown, one of the lawyers representing the center, asked for at least 30 days to prepare a defense for his clients.

  • "I don't want to give you 30," Goodman said. "Will 14 days be sufficient?"

    "Whatever you say, your honor," Brown responded.

    The lawyers got 18 days. The hearing is scheduled for 1 p.m. April 7 in council chambers.

    The center's business license has already been suspended.

    On Feb. 27, health officials announced that the clinic had reused syringes when administering anesthesia to patients.

    That raised the possibility of contaminating vials of medicine, which were then used on other patients.

    Six cases of hepatitis C have been linked to the clinic.

    On Wednesday, council members Lois Tarkanian and Steve Ross and city attorney Brad Jerbic all disclosed that they had relatives who were patients at the clinic during the period investigated by health officials.

    Ross and Tarkanian were still allowed to vote on issuing the complaint.

    Cynical Observer wrote on March 20, 2008 02:25 PM: Who is attorney Jay Brown, the lawyer for Endoscopy Centers (aka Desai & partners)? Jay Brown is a "zoning, corporate and gaming lawyer". But he's also a very close friend of Harry Reid. The same Harry Reid who said that Dr. McBride shouldn't be removed from the Nevada Board of Medical Examiners even though McBride is president of the largest medical malpractice insurance company in Nevada.

    How are Brown and Reid tied together? Remember this story from the Associated Press by John Solomon and Kathleen Hennessey:

    "Senator Reid and Jay Brown, Reid's longtime friend and former casino lawyer, were involved in real estate between 1998 and 2004.

    -The deal began in 1998 when Reid bought undeveloped residential property on Las Vegas' booming outskirts for about $400,000. Reid bought one lot outright, and a second parcel jointly with Brown. One of the sellers was a developer who was benefiting from a government land swap that Reid supported. The seller never talked to Reid.

    -In 2001, Reid sold the land for the same price to a limited liability company created by Brown. The senator didn't disclose the sale on his annual public ethics report or tell Congress he had any stake in Brown's company. He continued to report to Congress that he personally owned the land.

    -After getting local officials to rezone the property for a shopping center, Brown's company sold the land in 2004 to other developers and Reid took $1.1 million of the proceeds, nearly tripling the senator's investment. Reid reported it to Congress as a personal land sale.

    The complex dealings allowed Reid to transfer ownership, legal liability and some tax to Brown's company without public knowledge, but still collect a seven-figure payoff."

    Didn't Oscar vote and his buddy Jay Brown was Desai's attorney. Jay Brown is Harry Reids land windfall buddy.

    Its like installing taffic lights, unless someone they think of value is impacted nothing is done til someone dies
