OSHA reviews Orleans probe

Nevada's handling of matter scrutinized

Federal officials are trying to determine whether Nevada officials mishandled an investigation of a sewer system accident that killed two men at The Orleans last year.

Richard Terrill, acting regional administrator of the U.S. Occupational Safety and Health Administration, on Monday confirmed that the federal agency is looking into Nevada OSHA's handling of the accident investigation. The review, which was spurred by a complaint filed by the mother of one of the victims, stems from a fatal accident that occurred when a maintenance crew was called to unclog a pipe in a sewer pit at The Orleans in February 2007.

  • Outside contractors had handled such problems in the past.

    Stinking fumes were leaking into the air when Richard Luzier, 48, a married father of two, climbed into the sewer pit despite warnings from co-workers.

    Luzier fell face first into the wastewater at the bottom of the pit and Travis Koehler, 26, a new journeyman engineer, jumped into the hole to save him. Both men died inside the sewer pit.

    A third man, David Snow, 30, who entered the pit to help the workers, was rescued by the Clark County Fire Department.

    Some witnesses said supervisors ordered Koehler and Snow to enter the pit.

    State officials in August fined Boyd Gaming Corp. $185,000 for nine safety violations, but Debi Koehler-Fergen, the mother of Travis Koehler wasn't satisfied.

    She called the fine mere pocket change to the large casino company. She said the company should have been cited for "willful" violations of safety rules and that the supervisors should be prosecuted criminally.

    Koehler-Fergen said the lead investigator for the Nevada OSHA joined in filing the complaint. She declined to identify the lead investigator, who she said now works for another state.

    Federal and state officials also refused to identify who signed the complaint, citing government rules.

    Boyd Gaming spokesman Rob Stillwell said the company was upset by the new review because it was forcing the company to have to "relive the tragedy." Stillwell said the Nevada agency's findings were reported earlier.

    Koehler-Fergen, however, said a federal investigation into the incident is necessary.

    "After you called this afternoon, I was shaking. Yes, I'm angry. My son and I were very, very close," she said. "But if this (complaint) makes a difference, that will make it worth it to me."

    Koehler-Fergen said Nevada OSHA generally imposes small fines on casino companies and large construction companies that have job site fatalities, giving corporations little incentive to comply with safety rules.

    If the state's worker safety agency took tough action, "then maybe people wouldn't be dying all the time," she said.

    "Obviously, this is just a widespread problem, and I encourage everybody to file a complaint," Koehler-Fergen said.

    State spokeswoman Elisabeth Shurtleff said in an e-mail: "Nevada OSHA cannot comment on open investigations."

    Nevada OSHA, however, released a March 2007 memo in which investigator John Olaechea said "willful citations are appropriate" in The Orleans sewer accident.

    "A higher management official was aware of an OSHA standard or law applicable to the company's business but made little or no effort to communicate the requirement to lower level supervisors and employees," Olaechea wrote.

    The state investigator said Boyd Gaming corporate risk manager Don Barker showed "indifference" about worker safety.

    Barker, however, said his superiors at Boyd prevented him from following safety regulations, according to Olaechea.

    "During a conversation with Don Barker, he claimed that he was unable to correct the confined spaces issue due to interference from upper level management within Boyd and at The Orleans," Olaechea said in the report.

    Terrill said the federal review is focused on the state's administration of OSHA rules, not on whether or not the casino was in compliance with safety rules. The federal agency is "investigating to see if the state followed their appropriate procedures," Terrill said.

    Nevada is among 26 states that adopted their own worker safety regulations and received federal approval for standards that were at least as stringent as the federal government's, Terrill said.

    Terrill expects the San Francisco regional OSHA office to complete its review within a few weeks. At that time, the federal occupational safety division may make recommendations to Nevada OSHA, but Terrill declined to discuss other potential action.

    Koehler-Fergen fears federal officials won't take strong action.

    "If the federal level does not come down and clean office (in Nevada)," she said, "then they are just as guilty (as Nevada officials)."

    In early 2000, I became a Federal Whistle-blower thru no fault of my own.

    I made the mistake of calling OSHA.
    I did it anonymously after trying to resolve an issue at a jobsite.
    The contractor began dumping chemical dust "fireproofing" off the upper floors of the project to "speed things up." Instead of this chemical waste dust hitting the dumpsters below, it immediately became the air that we breath. It made me very sick, as well as others. I asked them to stop. They didn't stop. I called OSHA. I told them that I had video taped it so they could actually see the process. OSHA responds to the site within days. No dumping occurred while OSHA toured the site.

    Lots of interviews. Lots of eyewitnesses.

    OSHA RESPONSE? IGNORED OUR COMPLAINTS.

    The contractor bombed us the next day as punishment for calling OSHA. This was more severe than before. We got nailed. I call OSHA back. I ask them if they told them to stop. THEY SAID NO

    I call the head of OSHA, Danny Evans.

    Danny Evans calls the Investigator.
    Within minutes, she is back on site.

    She walks up to someone that she guesses might be the caller and RATS HIM OUT IN FRONT OF SAFETY. She got the wrong guy. ALL HELL BREAKS LOOSE.

    I get fired within minutes of stepping up.

    I beg Harry Reid for his help.

    Harry asks Governor Guinn to get a hold of OSHA and take another look.

    OSHA comes out in force, puts on a show and COVERS UP the whole event with all kinds of B.S. documentation.

    REID AND GUINN RUN BACK INTO THERE HOLES.

    Long story short. I file Federal complaints against Nevada OSHA for their misconduct. Federal OSHES covers it up. I call WASHINGTON D.C.

    FED OSHA will do nothing. They go after the messenger FAST.

These 3 families live it daily and as a friend of Debi's, I know how it has affected her life and family. This guy is a total IDIOT to make a statement like that. He's just trying to keep Boyd Gaming out of the spotlight again and as far as I'm concerned - I hope the spotlight never goes out on this episode until everyone gets more than a paltry slap on the wrist.

    Mr.Senator isn't it about time that YOU show some interest in this matter, isn't it about time that you spoke out on behalf of the people that have elected you to office,isn't it about time that you contact OHSA and tell them that they are killing people in Nevada with their handling of investigations?
    I for one question why any working man or woman of Nevada should continue to vote for you ever again.
    The Casinos may supply you with funds for reelation but they DO NOT cast the votes.
    I say it,s time for you to do something!

Was it in remembering that you had to write out a few checks for death benefite, a few checks for OSHA fines? Maybe Boyd relived it during the news reports. Or perhaps when they had to take the time and money to hire new people to fill the positions of those they killed through their negligence. How dare you make a comment about Boyd Gaming reliving this tragedy. My family has lived this tragedy every damn day since Feb 2. I wish you could step into my shoes that first week after the incident and experience just half of what I went through. Shame on you. Shame on William Boyd for allowing this company to become what it is - a negligent, greedy corporation.

Your company totally disregarded State & Federal Safety Regulations, which resulted in two deaths. Get your head out of your butt and show some compassion - stop being a "good little sheep." Has anyone been fired for their part in this disaster? Those responsible should be brought up on criminal charges because they willfully broke the law resulting in two innocent fellow human beings dying. Travis died attempting to save his fellow worker, while the boss stood safely out of harms way - how convenient. Mr. Stillwell you & your company caused your own nightmare by flagrantly breaking the law, and totally disregarding the safety of your employees. Why on this day did you not call in the usual outside company to remedy the situation?...were you trying to save a few bucks? You should be ashamed of yourself for what you have done.

    The people at OSHA other than the original inspector should be held accountable for their actions in this. What a crock of bull for OSHA & Boyd Gaming to meet behind closed doors and discount the two lives that were lost as they did. If you don't have anything to hide do it in the open for all to see gentlemen. What special favors are being doled out in private by these large companies to OSHA representatives?

    I thought OSHA was responsible for protecting the worker, but here in Nevada they along with many other agencies protect big business/Casinos. OSHA should be held partially responsible for the deaths that have taken place here in Las Vegas because they have failed to do their job...willfully failed to do their job!

I live with the fact that my son will never be coming home to hug me, to smile for me, to tell me he loves me while you and all the others involved all the way up the chain get to go home to your families. DO NOT tell me or the world that you're "upset by the new review because it was forcing the company to "relive the tragedy"". I live with it every day all because safety was not a priority. If it were the 'outside company'would have been called in like they usually were. No, LittleBird, they were not trained because this outside company was always called in except that day. Mr. Stilwell, since I live without my son every day then you and all the rest can relive the tragedy with the knowledge that because of the indifference to safety 'the company' killed my son and Rick.
