7-YEAR-OLD INJURED: Parents to face charges after 10-year-old boy shoots girl in face

Police allege couple's son used unsecured handgun to shoot girl

The parents of a 10-year-old boy who shot a 7-year-old girl in the mouth last month face multiple felony charges in connection with the shooting because the .38-caliber pistol used by the child was not properly secured, a police report released Monday states.

According to the report, North Las Vegas residents David and Karen Wachner face one count each of child neglect with substantial bodily harm, reckless endangerment and child endangerment.

  • The report alleges the Wachners were at work and not at home the morning of May 21, when the boy shot the girl as the friends were playing "cops and robbers" at the house in the 500 block of Blackbird Knoll Court, near Centennial Parkway and Commerce Street.

    North Las Vegas police Sgt. Tim Bedwell said the girl is out of the hospital and a tragedy was averted when the bullet hit a tooth and fragmented. The shooting left a hole in the girl's mouth, according to the report.

    Bedwell said she was lucky to survive.

    He said the incident is a prime example of how keeping unsecured guns inside the home can have serious consequences.

    "So many people think this couldn't happen to them in their home," Bedwell said. "It does happen."

    He added that his department and other local police departments give out gunlocks for free.

    He said the boy will not be charged in the shooting, not even as a juvenile.

    "There was never any indication he intended to hurt the girl," Bedwell said.

    "That, coupled with his age, really puts the responsibility in the hands of anyone negligent enough to let the child get a hold of that weapon," he said.

    A woman who identified herself as Mrs. Wachner slammed her front door Monday evening when a reporter tried to speak with her.

    The police report states that the Wachners kept several unloaded guns unsecured inside their home, including a .27-caliber rifle, a .22-caliber rifle and a 12-gauge shotgun in addition to the pistol used in the shooting. The pistol was kept in a case next to the Wachners' bed, while the rifles were kept in cases inside a closet, the report states.

    According to the report, Karen Wachner told police her son was caught by an older sibling playing with a shotgun about a year ago.

    "Karen stated that one of their daughters caught (him) playing with the shot gun about one year ago and her and David counseled him on the safety of the rifle but failed to keep them secured," the report states. The Wachners have two daughters, ages 17 and 14.

    The report states that the boy learned how to shoot the weapon by watching "CSI" on television.

    David Wachner, 39, was jailed at the Clark County Detention Center on $40,000 bail. His wife was expected to turn herself in to police today, police said.

    According to the report, the Wachners' son has been staying home alone for about an hour on weekdays since about Christmas of 2008 and locking up the house before he leaves for school.

    The report states the child often goes to the girl's house before school and they return to his house, where he picks up his books before getting on the bus.

    The day of the shooting, the boy went to the girl's house carrying the gun in a case. The girl's mother, identified in the report as Carol Monk, asked him what was in the case, and the boy then removed the gun and pulled the slide back, showing Monk the gun was unloaded, the report states.

    The report also states that the boy told police Monk told him to get the gun out of the house because "her dogs did not like guns."

    Monk then told the boy to put the gun back where he found it before he and her daughter went to the bus stop.

    Once inside the boy's house, the girl asked him to play cops and robbers, the report states.

    "They went upstairs where he chased her around," the report states. "He then took the gun out of the case in his parents' bedroom and put a bullet into a magazine."

    The report states the boy put a bullet he thought was blank -- because "it was missing the front" -- into the magazine. He then raised the gun and fired it four times without it going off. He raised the gun again, pointed it at the girl's face and pulled the trigger, firing the shot.

    The injured girl then ran home.

    Monk drove her daughter to the hospital, but only after she stopped by the boy's house, knocked on the door and screamed for him to give her his father's cell phone number. The boy never answered.

    That is when she called 911 and told the dispatcher that she was on her way to the hospital.

    Christine Skorupski, a spokeswoman with Clark County Family Services, said she could not comment on whether her agency had previously responded to the Wachners' house before the shooting. She also said she could not comment on whether the Wachners' children were in her agency's care because of confidentiality laws concerning nonfatal shootings.

    David Wachner's initial appearance in court is scheduled for Wednesday.

Nevada law states that it is a crime to knowingly put a child in danger and this includes NOT taking action to prevent a child from endangerment. There are legal issues ahead for the Wachner's no doubt, but I think there is a serious injustice being done here. I am not a civil attorney or I would lead this charge myself. Mrs. Monk is the one that should be sought for child neglect and endangerment. Merely possesing a firearm is not a crime, in fact it's a constitutional right. Perhaps gun safety may have been lacking to some degree in the Wachner's absence but the innaction of Mrs. Monk, by law, constitues child endangerment. Turning your head does not make the problem go away, we learned that as infants. Besides, common sense is a phrase you'll hear in any courtroom and my experience has shown that judges like that phrase a lot! I wouldn't be a bit surprised to see a defamation lawsuit filed against Mrs. Monk in the near future, any self-righteous person that would stand up for that fight has my vote.

    kaylah wrote on June 29, 2009 09:08 PM: i think youre a fool carrie. yes we understand that gun safety is important but like you said..there are 2 sides to every story. you cant just sit around and point fingers. and it is an election year, i also believe that part of this is so the DA can get some votes in his pocket. from what i understand the gun wasnt loaded and it was properly stored. yes its a tragic ACCIDENT but you need to understand that mrs. monk couldve prevented this entire thing. and she said that the reason she told him to get out of the house with the gun is because of her dogs! are you kidding me!? wow... and then her stopping by the house to yell at the boy BEFORE taking her daughter to the hospital. thats just rediculous! this was very unfortunate, but i think that the media blew this way out of proportion and the parents of this boy shouldnt have been arrested at all. they shouldnt have 3 felonies either. mrs monk should have them for KNOWINGLY putting her daughter and the boy in danger. thats my opinion in this matter.

I do know that family and they are good people too. I have a right to say that as everyone said about the other family. and there is two sides to every story.     CSI did not bring this gun into his home....... his parents did.

    The DA did not let his child go with a 10 yr.old that was known to have a gun because HIS DOGS WERE SCARED OF GUNS!

    Get the facts straight. Stop blaming everyone and anyone but the irresponsible adults in these poor children's lives!

    voting season wrote on June 28, 2009 04:22 PM: The charges that are being filed dont make sense at all. That is why people are blaming the DAs office. Everyone knows that when its a voting year they try to put people in jail that dont need ti be in jail. Why would you file charges for an accident? The gun wasnt loaded and to me that is properly stored it wasnt loaded and you need to learn to load it but since he saw it on CSI then he knew how to load it. How can some of you not see that it was an accident? Accidents do happen because no one is perfect i cant imagin how the parents feel. The girl is fine or did you not read that part of the article? Mrs. Monk should have taken the gun away from the young boy do you realize that that poor kid has to live with that nightmare for the rest of his life no i dont like you understand that. People make mistaked that they are not proud of and no one is perfect. So get your facts straight....

    Parents CARE and take care of their children and keep them FROM harm, not lay guns around tempting them. They surely do NOT send the kid home WITH a gun and say go with him and get the bus.

    The Wachner's abosolutely should have been very careful having weapons and children together in their home, let's not discuss leaving a 10 yr. old alone unsupervised.
    Mrs. Monk is unbelievalbly stupid.The 3 adults FAILED those two children and absolutely should be charged equally!!

I cannot believe this how can you go after a family who did nothing wrong? To me he was taking it to an adult who isn't really doesnt care about the safety of her kid or any other kid on the block. Cannot sit there and tell me that you are going to charge this family with child endangerment cause that is just ridiculious. What about the mother? you are trying to take both of the parents of these kids when they need them more than ever at this harsh time in their life i can't imagin what they must be going through. But you can't charge the mother with anything. I was talking to my husband and he said you know what sweetheart it's voteing year of course they are going to throw charges that dont even my any sense. Are you kidding me? Why Why do you people plan to take two parents who seem very great away fromthere kids? There is other people who deserve to be in jail and these people are not one of them. Mrs. Monk yes her daughter should be taken away from her that is what my opinion is cause that is just stupid why would you not take a gun away from a child? Wow lady you have some serious problems.
