Wynn breaks with nightclub mogul after arrest with Hilton

Wynn Las Vegas announced Wednesday that it has cut ties with a nightclub mogul after he was arrested on suspicion of driving under the influence of alcohol with celebrity socialite Paris Hilton on Friday night and has banned Hilton from its properties.

Cy Waits was stopped by a motorcycle officer who said he smelled "a strong odor of marijuana" coming from Waits' 2009 Cadillac Escalade on the Strip near the Wynn Las Vegas hotel and casino.

Las Vegas police believe they found a "roach," or a used joint of marijuana, in the vehicle, according to Waits' arrest report. Waits' girlfriend, Hilton, also was in the vehicle and later was arrested for felony cocaine possession.

On Wednesday, a spokeswoman for Wynn announced that Waits is "separated from the company and is free to pursue other interests." Waits, along with his twin brother, Jesse, was a managing partner of the nightclubs Tryst and XS. Jesse Waits will continue as general partner of the nightclubs.

Hotel developer Steve Wynn also banned Hilton from his Las Vegas properties after her arrest, a company spokeswoman confirmed Wednesday.

Waits' arrest report said he failed several impairment tests, including swaying while balancing, using his arms to balance, and was not able to stand on one leg without putting his foot down.

Waits also had bloodshot eyes, his breath smelled of alcohol, and he was wobbling, the report said. He was polite, cooperative, and submitted to a blood test, according to the report.

The report said police found "a 'roach,' white piece of rolled paper w/ green leafy sub inside. It was wet + unable to be tested." Police found Zig-Zag-brand rolling papers in Hilton's possession, the report said.

Waits' attorney, Richard Schonfeld, said Wednesday that he was "troubled by the arrest," because he believes the officer didn't observe any traffic infraction or other indication that Waits was impaired. Schonfeld added that Waits passed the Horizontal Gaze Nystagmus field sobriety test, which tests the eyes.

But according to the arrest report, Waits failed two other field sobriety tests.

And arresting officer Michael Polion wrote in the report, "I could smell marijuana coming out of the vehicle, pulled up to passenger side and driver stated he just got done smoking."

Waits, 34, was arrested on a misdemeanor charge of driving under the influence of alcohol or drugs. He spent the night in jail before he was released on $2,000 bail with a Nov. 29 court date.

Hilton, 29, was arrested on one felony count of cocaine possession after a police lieutenant discovered a baggie of cocaine when she opened her purse to retrieve lip balm and the plastic baggie fell out. Hilton claimed the cocaine wasn't hers.

Hilton was freed without bail before dawn Saturday after spending less than three hours handcuffed on a jailhouse booking room bench. She is scheduled to appear before Las Vegas Justice of the Peace Joe Bonaventure on Oct. 27.

    Wynn is a hypocrit, does he ban drug charged GAMBLERS , who are athletes, actors, child pedophile Michael Jackson, singers, etc. NOT TILL NOW, probably Paris doesn't gamble and her family are competition

    @Green.. do we really want the cops sniffing cars as they drive by at 3 mph down the strip? Personally I don't know of ANY weed smokers who have caused highway mayhem and destruction.. it's always the drunks who do that. Perhaps anyone who smells of booze coming out of a any casino, bar, or restaurant in town should be sniffed out and pulled over? I'm not a smoker of weed or a drinker of booze, but seems to me like we have our police focused on the wrong things to me.. I'm sure if you pulled over ANY car on the strip after midnight you have a 50/50 chance of finding something illegal or else an inebriated driver.

    @Dennis-

    The officer stopped them because he had reasonable suspicion of the use/possession of a controlled substance due to the smell of burning marijuana and visible smoke from the windows of the vehicle. Did you miss that part?

I guess there are a lot of people who roll their own cigarettes right? You can buy zig zags at 10000+ places within a mile of your house... but don't get caught with them in your purse..... again, the hypocracy in this town is nothing short of AMAAAAAAAZING.

    I'm sure Wynn is SHOCKED!!! SHOCKED to learn that someone in one of his clubs is using cocaine!!! OH MY!!! The hypocracy in the town, by the ones who profit the most, knowing FULL WELL what's going on.. well, it's AMAAAAAZING.

    It is a social thing. No one was harmed but it is national an international news. Go figure.

    He was not doing 109 mph. I wonder if this is the same officer that took four and a half hours to respond to my fender bender?

    I think they could abandon the drug sniffing dogs that can't find a stinking dead body in a house. I is obvious the officers on duty have a keener sense of smell than the dogs.
