CARSON CITY -- The Nevada Pardons Board refused to release an inmate in need of a kidney transplant who is serving time for killing a bicyclist while driving drunk.

The board took the action Tuesday in the case of Erik Randall, 33, who pleaded guilty in the 2001 death of 28-year-old Francisco Sanchez in Incline Village.

Randall was sentenced to five to 15 years in prison for DUI causing death, and another four to 10 years for hit and run. He has three years left to serve on the sentences that are running consecutively.

Randall's lawyer Richard Cornell asked the board to make the sentences concurrent, which would allow the release of his client and save the state the cost of dialysis while he is in prison.

"He has a serious kidney ailment that requires dialysis or transplant soon," Cornell said.

Five state Supreme Court justices and Attorney General Catherine Cortez Masto voted against the pardon, saying serving out the sentence was part of Randall's recovery from alcoholism.

Justice James Hardesty and Gov. Jim Gibbons voted to grant it.

Sanchez, the father of two children, was thrown more than 200 feet when he was struck from behind by Randall's Ford Bronco.

Good for the pardon board! What difference does it make to the state financially to support him and give him dialysis in prision or pardon him and have him file for medicaid to pay for his dialysis??? We are still paying to take care of a murderer... one that should take his last breath in prision... I am sure his victim didn't get much choice where his last breath was. Sympathy is in the dictionary, please go look it up.

The 'reason' that he should be let out so it doesn't cost taxpayers money for this so-called needed operation doesn't hold water - even if he DOES get out - WE WILL PAY - does anyone really think the man has a job w/benefits waiting for him to pick up the tab? So we pay one way or another - Gibbons is a real dumb-azz

my grand partent lost a daughter(my aunt)in the mid 50's in Az. A drunk ran a sign or light, it was the 2nd day of her honeymoon. I was born some 10 years later. My grand partents would cry when her name came up in the 80's when her name was mentioned. She was the youngest. My uncle her brother is still alive-my only ds,only living relitative, as he never had kid's so i have no cousins. He is 86 almost 60 years later and he still tears up. 60YEARS !!!!!!!!!!!!!! I would have cousins had she lived and had kids, now I have only my 86yr old uncle.

MY POINT IS WHEN YOU KILL SOMEONE IN CAN HAVE AN IMPACT ON PEOPLE 100 YEARS LATER. IT WILL ME IF I MAKE IT 30 MORE TO 73.

So saying "Whats 3 more years?" he destroyed my family as I'm all that's left. He should be hung, I dont care ifhe had a drinking problem-dont make his problems other peoples problem.

With all the DUI's in Vegas it makes me sick how manyfamilys are destroyed-the collateral damage not the direct damage that only shallow people see.

The Warden who would like a promotion to Hangman.

Really, this guy sure didn't give much sympathy to the man he killed. And, yet, we the tax paying citizen, must pay for his dialysis. Sorry, let him go without. Is anyone surprised by Baboon Gibbons wanting to pardon the killer. Gibbons once again proves he is a joke to this state. It will be no loss to anyone if this mans dies which is what he deserves. Sorry, no sympathy from this Vegas Gal. He gets better care than most citizens in this state all at our expense folks. What a crock of cow dung.
