ERIN NEFF: Gibbons and the sweetheart deal

Each time I pen a column critical of Gov. Jim Gibbons, the 20 percenters who still support him suggest I find a new topic.

So today's column will be about ethics.

  • Nevada law is often criticized as being too gray to deal with the often-fuzzy actions by public officials. But NRS 281A.400(2) doesn't present a lot of wiggle room.

    "A public officer or employee shall not use his position in government to secure or grant unwarranted privileges, preferences, exemptions or advantages for himself, any business entity in which he has a significant pecuniary interest, or any person to whom he has a commitment in a private capacity to the interests of that person."

    Let's say you were the governor and you had plans to build a retirement home on 40 acres in Elko County. And let's say you purchased the land by cobbling together off-book donations from contractors under the guise of using your "congressional pension."

    And let's say that you just really didn't want to have to pay $5,000 in property taxes on the site. In fact, $15 looked much better. But what's a lowly governor to do when the tax assessor tells him he just doesn't qualify for an agricultural exemption, what with his 40 acres and no mule?

    Well, if it's our governor, he makes a personal visit.

    He also picks up the phone and gets some help from a politically connected attorney who serves on the state Tax Commission and also just happens to be the son of a well-respected rancher/assemblyman. The assessor, Joe Aguirre, told The Associated Press he felt pressured and "uncomfortable."

    The comments by Aguirre, published in Sandra Chereb's Associated Press story in Saturday's Review-Journal, make it clear Gibbons used his position to obtain an unwarranted privilege.

    If I went to the Clark County assessor and asked for an agricultural exemption for my 1/4 acre, you can bet he'd summon the feds to find the marijuana plants.

    I can think of no other way I'd make enough cash on my property.

    Of course the county assessor would tell me to take a hike because the exemption wasn't warranted.

    When you're the governor and you pay a visit to the local assessor, it's already a bit different. Gibbons K. Citizen certainly couldn't pressure an assessor to do something. But Gov. Jim Gibbons can, and did.

    Aguirre told the AP it "seems odd" that a member of the Tax Commission was tapped to send the application on behalf of Gibbons. "I did feel uncomfortable," Aguirre said.

    Translation -- Aguirre, a Republican stalwart in Gibbons Country, worries about his future in the assessor's office if he doesn't grant Gibbons an unwarranted exemption.

    If Gibbons had tried to pull this with a Democratic assessor, the public might just assume the local official was crying political foul.

    Aguirre's comments speak to ethical fouls.

    And in Nevada, an official found guilty of breaking the law loses his seat.

    It's long passed time for Gibbons to return to his roots with rocks. He's got a fitting personality.

    So bring on the ethics complaint, please.

    Subpoena John E. Marvel and Joe Aguirre.

    If Marvel were honest and not just covering his tracks, he might tell the Ethics Commission that he felt it would be good for his business as an attorney to have a friend in the governor's office.

    Maybe Gibbons promised him a seat on the Tax Commission in perpetuity. Such an appointment couldn't hurt his business.

    And what will Aguirre do? If it were just the facts, it would seem a slam dunk.

    Maybe the feds will come poking around this little transaction. We know they're already interested in the purchase of the land.

    Darn it anyway. Buying land is just like those government programs Gibbons hates. Not only do you have to pay for it, you have to keep paying each year.

    There's no way around it. Gibbons got something you and I couldn't just because he's governor. And that, my friends, is just another reason why he shouldn't be governor.

    We haven't even prosecuted Fran Deane yet. (Why IS she above the law?) How many years ago was that? You would think that more than, what, more than 5 felonies should get you jail time.

    We have Metro cops eating in the Employee dining rooms at the local casino's, and I can't even begin to enumerate the county commission ethics violations.

    And hilarity ensues...

    Let me begin by disproving your assumption and apologizing for any misinterpretation of my comparison of the Republican Party to the post WWII Nazi Party - it was a historical reference, in an attempt to state that political parties do run their course over time and eventually become so corrupt they are, or should be, disbanded.

    It would be unfair to compare to Bush to Hitler - Bush is not quite as bad, as he's only caused the unnecessary deaths of over 4,000 Americans (not including the over 6,000 suicides related to military service in an illegal, unethical, immoral and Unjust War in Iraq). Would a comparison to the deaths of over 3,000 Americans be better for you?

    That's not taking into account the millions of Iraqi's that have been displaced into homelessness, or wounded, maimed or killed - it seems there are only estimates and no one is accurately counting these statistics?

    That is really disgusting!

    Let me be clear, I have many, many Republican friends that are angrier at the corruption of their party leaders - and they are leaving their political party in droves by re-registering - with my sympathies!

    Just so you know, I do all I can to hold my party, and our leaders, fully accountable! I'm first and foremost an Veteran's and Military Families Advocate and Activist - and a Precinct Captain, a member of, both, the County and State Central Committee - all in the role of a "watchdog" citizen!

    RFK, Jr. said recently on a segment with Larry King "What the American people need to realize is that 95% of the Republican Party and 75% of the Democratic Party are corrupt!"

    I agree - it's THAT "sad"!

    So, clean up your party (if it survives 2008) and I'll keep working on mine!

    You may want to read the Statements that you make about others and look at them how you would view it you had the opposing view. Do I believe Titus is a sociopath? NO! Do I believe there are people in the Democratic Party that have problems addressing right from wrong, are corrupt or have ethics issue... of course... and I would be naive to say that the Republican party is free of that as well...

    Before calling for the disbanding of the Republican party, you should hold your same party accountable to the same errors and problems that you accuse the Republicans... but you take it too far.

    How dare you, sir, compare the Republican Party to the Nazi's in Germany after the war...

    In every possible disagreement with Democrat's policies, their leaders or their party, I have never once requested their disbandment or censorship. Nor would I ever suggest anyone else make those suggestions. We live in a land of choice, no matter how much we disagree with that choice, we must respect other's rights to have that choice and opinion.

    Sir... YOU ARE COMPLETELY OUT OF LINE and I would expect someone with character to apologize for such statements. I am guessing an apology will not be forthcoming.

    Which means only about 30% of the people in government are serving for the right reasons - that means the ethical minority is, already, widely overwhelmed by those corrupted with a desire for power and wealth - not good odds for any society to return to an ethical foundation under the rule of law...

    ...but, I'm convinced, in the minds of the Repulican Party leadership there is far darker disorder - they are sociopaths that care for no one but themselves - and Gibbons is a classic example! Ensign, Heller and Porter would fit the same mold - simply take the time to compare what they say (and don't say) against what they actually do - they represent themselves, and only out of political expedience, do they represent and help their wealthy donors. The Republican Party of today doesn't even represent most of their moderate members - it's all about the money and power!

    Frankly, if it were up to me, the Republican Party in America would be banned (much like what happened to the Nazi Party in Germany after WWII) - they don't deserve the opportunity to "re-brand" and recover. Driving the Republican Party into the political desert for forty years isn't enough in my mind - why let them ever rape America, or another generation of Americans, ever again?

    We all need to start taking ethics and the rule of law, American law, far more seriously to get America, and Nevada, back on track!

    I am one of the 80%. It's not that I want to see our governor fail. I would love for him to surprise us all and turn his term around. Sadly, he has approached his office with the skill of someone running for president of the junior high student council. His personal life, although entertaining, really doesn't make me dislike him. I dislike him because he isn't a leader, has poor judgement and doesn't appear to have any ethics.

I could think of a lot of people that are better suited for the governor's mansion. (Especially if the Supreme Court kicks off all those public servants from the ballot.)
